1. Application

CHANGE HELVETIC SUISSE (hereinafter referred to as “Change Helvetic” or “the Entity”), a branch of BNC Change (Switzerland) SA (the “Company”), provides its customers with an online currency purchase service, with the purchased currency subsequently collected at a designated office of the Company. The Company is registered with PolyReg and has its registered office at Florastrasse 44, Zurich, Switzerland. Change Helvetic’s registration number is: CHE-167.671.381.

2. Overview of the Terms of Service

The purpose of these Terms of Use is to define the provisions that apply to the User in connection with access to and use of the currency exchange service. These Terms apply to all product orders and contracts entered into between the purchasing customer (the “Customer”) and Change Helvetic, the operator. As part of the ordering process, the Customer accepts the Terms of Use in effect at the time the order is placed.

3. Acceptance of the Terms of Use and Changes

Any order constitutes unconditional acceptance of these Terms of Use.
The Company reserves the right, at any time and unilaterally, to supplement or modify these Terms of Use as it deems necessary. These Terms of Use may also be supplemented by specific terms and conditions, which must be accepted by the User prior to accessing certain services.
Amendments to these Terms of Use are binding on the User as of the date they are posted online. These amendments are communicated to the User, who must accept them, by any appropriate means.

4. Terms of Service

To use the “Click & Collect” service, access the website at www.changehelvetic.ch from a mobile phone, computer, or tablet connected to the internet.

a) Ordering Process
To use the “Click & Collect” service, access is via the website www.changehelvetic.ch using a mobile phone or tablet connected to the internet.

The order is placed directly on the website, and only certain items are kept in physical stock. Reservations must be made based solely on available items.

To place an order, the customer must provide their first and last name and an email address, in addition to any mandatory information required by Swiss law and anti-money laundering regulations in effect at the time of purchase.

Once the purchase form has been completed in accordance with the instructions, the customer must expressly accept these terms and conditions as well as the privacy policy.

In addition, orders may be subject to maximum limits per quarter and per year in accordance with applicable regulations; these limits may be modified at any time. Furthermore, placing an order results in the corresponding amount being held on the customer’s card. However, the transaction will not be considered finalized until the customer’s identity has been verified, in accordance with anti-money laundering and counter-terrorism financing regulations, at the time of the charge. If the customer is unable to complete the verification process, the transaction will be canceled and the blocked amount will be released. The customer will not be entitled to any compensation, and the Entity shall not be liable for the cancellation of the transaction.

b) Exchange rates, fees, and expenses
Before placing an order, the customer will be informed of the applicable exchange rate and any additional fees that may apply. Please note that licensed currency exchange offices are not required to use official exchange rates and may therefore add a markup.

c) Payment Method and Order Confirmation
Payment for the order can be made by credit card. The Company accepts the following payment methods: Visa, MasterCard.

A key prerequisite is that payments are accepted only from cards issued in the name of an individual.
Change Helvetic does not charge any additional fees for the use of credit or debit cards when purchasing its products. However, please note that the issuer of the customer’s credit or debit card may charge fees for its use.

Once an order has been successfully placed, the customer receives a confirmation email containing a pickup code, which is required to collect the order. The email also includes the following information: price, payment method, and contact details for the selected pickup location.

d) Order Pickup
The customer may pick up their order at the selected Change Helvetic office on the date chosen when placing the order on the website, during the office’s business hours. The order will only be handed over to the person who placed it, upon presentation of a valid ID.

Once the order is delivered, payment will be processed, and the hold placed on the order will be released.

If the order is not picked up within 15 days, it will be automatically canceled, and the funds held in the account will also be released. Please note that the release or cancellation of the hold is subject to the processing times of the customer’s issuing bank. Consequently, Change Helvetic assumes no liability for any delays or related issues. In such cases, the customer will not be entitled to any compensation, and Change Helvetic cannot be held liable for the cancellation of the transaction.

e) Cancellation
To cancel an order, customers must contact Change Helvetic’s customer service department as soon as possible at the toll-free number XXX and provide their original order number. Customer service will explain the procedure for returning the item. Additionally, Change Helvetic will consider the order canceled if it is not picked up by the specified delivery date.

5. Agreement

By using this service, the customer hereby confirms the following:

  • Be at least 18 years of age on the date of the transaction;
  • Use this service solely to purchase foreign currency for personal use;
  • For vacations, leisure travel, or business travel;
  • The customer has read and understood these terms and conditions and agrees to:
    • to comply with them;
    • to ensure that all information provided is true and accurate in every respect;
    • not to withhold any information of any kind related to the foreign exchange order;
    • to provide us with any required information and to cooperate fully with us in the event of an investigation of any kind that requires their assistance;
    • to comply with all anti-money laundering regulations;
    • be the holder of the card or bank account used to make the payment;
    • that the transaction is conducted for legitimate purposes and in compliance with the law or regulations.

6. Fees

The other party's bank may charge fees. Change Helvetic is not responsible for these fees.

7. Combating money laundering and terrorist financing

(1) Change Helvetic manages orders and fulfills sales contracts entered into with customers with the due care customary in the industry.

(2) Change Helvetic is required under the Federal Act on Combating Money Laundering and Terrorist Financing (AMLA) to identify the customer as a contracting party. To this end, the customer is required by law to cooperate. In particular, the customer must provide Change Helvetic with all information and documents necessary for their identification, as well as, where applicable, regarding the origin of the funds used to pay for the ordered product, and for clarifying the economic background of the proposed transaction. Throughout the business relationship, the client remains obliged to inform Change Helvetic promptly and without delay of any relevant changes relating to the above matters.

(3) Change Helvetic’s legal obligations include, in particular, the obligation to identify the customer and any beneficial owner in transactions exceeding CHF 5,000. Proof of identity is usually provided by presenting a valid identity document (such as an identity card or passport). In the case of a legal entity, the customer must submit an extract from the commercial register or a comparable official register and, if necessary, other appropriate documents. In addition, the client must provide at least the name of the beneficial owner and also prove their identity to Change Helvetic as described above; the Entity is also entitled to make a copy of the documents submitted for the purposes of identity verification.

(4) If the total value of transactions carried out during a calendar year exceeds CHF 100,000, the customer must complete a specific form and submit it to Change Helvetic before any order for products or services can be processed.

(5) In order to enable Change Helvetic to fulfil its obligations regarding the prevention of money laundering and terrorist financing, the client undertakes to provide all information and documents that may be requested by Change Helvetic, both at the outset and during the course of the business relationship, in particular to verify the client’s identity, that of the beneficial owner of the funds, and the purpose, nature and economic background of the transaction envisaged by the client. The client may therefore be asked at any time to provide explanations and any documents necessary to demonstrate, in particular, the origin of the funds, their intended use, or details regarding the client’s professional or commercial activities and those of the beneficial owner, as well as the client’s financial situation. The Client’s refusal or reluctance, without valid reason, to comply with the above undertaking means that Change Helvetic will not be able to process any product orders; furthermore, if a business relationship already exists with the Client, Change Helvetic shall be entitled to terminate any existing contractual relationship with immediate effect.

(6) In addition, the relevant provisions of the Federal Act on Combating Money Laundering and Terrorist Financing (AMLA), as well as its implementing ordinances, remain in force.

8. Personal data

BNC Change (Switzerland) may collect personal data concerning the Contracting Party and the Recipient of the transfer, in particular in order to comply with its obligations regarding the prevention of money laundering and terrorist financing. Personal data is processed in accordance with the provisions of the Federal Data Protection Act of 19 June 1992. Personal data may be disclosed by BNC Switzerland to third parties where such disclosure is necessary for the performance of the services offered, at the request of the competent authorities, or with the express authorisation of the Contracting Party. The Contracting Party agrees and authorises BNC Suisse to disclose their data, in particular their surname, first name, date and place of birth and address, as well as those of the Recipient of the transfer and any information relating to the transfer of funds, to the Recipient Banks or to any other party involved in the transfer of funds, both in Switzerland and abroad. Although in France data generally enjoys protection equivalent to that in force in Switzerland, the Contracting Party acknowledges that data transmitted abroad is no longer protected under Swiss law.

9. Limitation of liability

BNC Change (Switzerland) is liable for the proper performance of Change Helvetic in accordance with the terms of these Terms of Use, and in the event of non-performance or partial performance of Change Helvetic, shall only be liable for loss of interest, to the exclusion of any loss of profit.

10. Severability clause

If one or more provisions of these Terms of Use are found to be invalid, such invalidity shall not affect the other provisions, which shall remain valid and continue to apply.

11. Complaints

Change Helvetic takes particular care to listen to its customers’ comments and complaints, and strives to provide a high-quality service by doing everything possible to ensure their satisfaction. 12. Governing law and jurisdiction

The relationship between the Contracting Party and BNC Change (Switzerland) is governed exclusively by Swiss law. The place of performance and the exclusive venue for any legal proceedings shall be the registered office of Change Helvetic, subject to appeals to federal authorities in the cases provided for by law.
